Terms of service

Tomatillo is operated by Prayerson (“we”, “us”). These terms govern your use of the Tomatillo website and application (the “Service”). By creating an account or using the Service you agree to them.

1. The Service

Tomatillo is a web application for planning social media content, previewing posts, collecting client approvals and publishing approved posts to connected social media accounts.

We may improve, change or discontinue features over time. If we remove something material from a paid plan, we will tell you in advance.

2. Accounts

You must provide a valid email address and be at least 18 years old, or the age of majority where you live, to create an account.

You are responsible for everything that happens under your account and for the people you invite to your organisation — team members and client approvers alike. Keep access to your email account secure, because sign-in links are sent there.

3. Your content

You keep all rights to the content you upload or create in the Service — captions, images, videos, comments and notes (“Your Content”).

You grant us a limited licence to host, store, process, display and transmit Your Content only as needed to provide the Service to you, including publishing it to the social networks you connect and tell us to publish to.

You are responsible for Your Content and confirm that you have the rights to use it, including any rights needed from your clients.

4. Connected accounts and third-party services

The Service can connect to third-party services such as Meta (Facebook and Instagram), X, LinkedIn, TikTok, YouTube, Google Drive, Canva, Adobe Express and Slack. Your use of those services is governed by their own terms, and we are not responsible for their availability or behaviour.

You may disconnect a connected account at any time. Social networks may change or restrict their APIs; where that affects publishing or analytics, we will do our best to keep things working but cannot guarantee it.

5. Acceptable use

You agree not to use the Service to:

  • publish content that is unlawful, infringing, deceptive, harassing or hateful
  • send spam or violate the rules of any connected social network
  • attempt to access accounts, workspaces or data that are not yours
  • interfere with, overload or reverse-engineer the Service
  • resell the Service without our written permission

We may suspend or terminate accounts that break these rules.

6. Plans, payment and renewal

The Service offers a free plan and paid subscription plans, described on the pricing page. Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled.

Payments are processed by Dodo Payments, which acts as the merchant of record for all purchases. Dodo Payments handles the payment transaction and any applicable sales tax, VAT or GST, and its own terms apply to the purchase.

We may change prices for future billing periods. We will give you at least 30 days’ notice before a price change affects an active subscription.

7. Cancellation and refunds

You can cancel a paid plan at any time from the Billing page. Cancellation stops the next renewal; you keep access to the paid plan until the end of the current billing period.

Refunds are described in our refund policy, which forms part of these terms: in short, a full refund is available within 14 days of your first payment on a plan.

8. Plan limits

Each plan has limits on client workspaces, team seats and the social networks you can connect. If you move to a plan with lower limits, nothing you already have is deleted, but you will not be able to add more until you are back within the limit.

9. Termination

You may stop using the Service and ask us to delete your account at any time by writing to hello@trytomatillo.com. We may suspend or terminate your access if you materially breach these terms or if required by law.

After termination we delete your data as described in our privacy policy.

10. Disclaimers

The Service is provided “as is” and “as available”. We work hard to keep it reliable, but we do not guarantee that it will be uninterrupted or error-free, or that every post will publish — social networks can reject, delay or remove posts for their own reasons.

Previews are our best representation of how a post will appear; each network controls its own final display.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

12. Changes to these terms

We may update these terms. If a change is material we will notify you by email or in the app before it takes effect. Continuing to use the Service after the change means you accept the new terms.

13. Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute, subject to any consumer protections that apply where you live.
